DIVORCE WHILE WIFE IS PREGNANT BY OTHER MAN
Question Details:
MY WIFE IS PREGNANT BY ANOTHER MAN, WE HAVE BEEN SEPARATED FOR ALMOST A YEAR. I AM FILING FOR A DIVORCE DO I HAVE TO GET A COURT ORDER PATERNITY TO PROVE I'M NOT THE FATHER AND THEREFORE CLEAR ME OF CHILD SUPPORT? DO I HAVE TO FILE BEFORE THE CHILD IS BORN SO AS TO OBTAIN THE BLOOD SAMPLE AND OTHER REQUIREMENTS WHEN THE CHILD IS BORN? SHE HAS SAID SHE KNOWS WHO THE DADDY IS, BUT SHE DOESN'T KNOW IF HE WILL TAKE RESPONSIBILITY. WILL I BE STUCK WITH CHILD SUPPORT?
I am a lawyer in CT and practice in this area of the law. You are not responsible to pay child support if the the child is NOT yours. You will likely have to wait until the child is born to have the partnity test. You can file for divorce BEFORE the child is born. in other words, you do not have to wait till the child is born to get legally divorced. If you are not the father, and the real father fails to take responsibility, you are NOT obligated to step in under any circumstances.

Are you a lawyer?
