Question: Divorce, Marriage, Alimony - California

Asked on 10/25/2009

Divorce and Pregnancy

My wife and I have been separated since February, I have decided to that I want to file for a divorce, but was informed that she is pregnant. I'm not the father, and she hasn't told me she is pregnant. What will happen if she really is pregnant? How will the judge know if she's pregnant or not; do we even have to bring up the fact that she's pregnant? Will I have to pay child support after the fact?

There would have to be a pregnancy test.  If she is pregnant, and you think that you may not be the father, then there would be a paternity test.  If you are the father, you would have to pay child support, and naturally, you would want your visitation rights.
