Question Details: My husband and I have a lawyer for reasons other than divorce. Can my husband retain this same lawyer for our divorce and is this a conflict of interest?

If this lawyer did represent you previously, he or she cannot represent your husband in the divorce without your consent.  Are you sure the lawyer represented you before?

Attorney Harrington is correct that your husband's lawyer would be precluded from representing him in an action against you if s/he had previously been counsel to you both.  You should make sure that s/he represented you both, and make sure that you did not sign a waiver.
