Question Details: I just bought a house and closed about a month ago. The other day a piece of mail came to the house addressed to the man who sold me the house. I opened it because of concern. It was from the Sheriffs Office letting him know that the Sheriffs Auction/Sale was scheduled for Sept. 18th! That's just a few days away. I paid market value for this house. NO ONE disclosed the fact that the house was being forclosed on. NO ONE told me that I could of bought it for less. EVERYONE rushed me to close on the house asap...even my Realtor. What are my rights? I just paid 30k too much for house!
Dear Cheated Purchaser: Immediately retain experienced legal counsel to advise nd represent you. Clearly, you've been scammed, and you may have recourse against your seller, your realtor, and the title company and its underwriter for title defect, etc., provided you were given a TPL or Title Protection Letter, and title Insurance policy as part of your purchase, and as reflected in the HUD1 statement you should have received at settlement (closing).
Retain legal counsel ASAP. Good luck!
