Difference between joint custody and joint residential custody and with joint will I have to pay child support? Where should I fill Michigan or Hawaii
Question Details: I am getting ready to fill and was wondering about. What is the difference? We have agreed to 50/50 we each get our son 6 months a year and split any travel expense. What custody do I want? With joint will I have to pay any child support, I am in the military a resident of Michigan but I live in Hawaii right now what state do I would be better to fill in?
With joint custody both parents participate in reaching decisions regarding the health, education and welfare of the child; the custodial parent gets child support. In a joint physical custody both parents have the ability to be with the child, typically joint physical custody is coupled with a parenting plan to determine who will be with the child at what particular time; usually there is no child support.
Joint legal custody is the preferred approach in most cases, but it may not be practical in cases where there is a high degree of conflict between the parents, or an inability to communicate and work cooperatively. Additionally, a court may not grants joint physical custody if it determines that it is only being requested to get out of child support payments.
