What actions must I take to assure the tax payment is made by the executor on a piece of property? 

Question Details:

 My deceased mother's estate is in probate and in her name. My brother is the executor. It has no value remaining except a commercial property worth $18,000. My 6 siblings and I are designated as the beneficiaries. Communication has broken down. He has been unable to sell it over the last 2years. He paid the 2008 taxes. He's asking the siblings to each pay 1/7 of the 2009 taxes of $656 in taxes. Some are unable to pay. I fear the county may take the land and sell it for taxes due. How can I protect my share?

There are various ways of verifying that the tax payment was made. The probate courts are usually very accommodating to people with questions. You can probably just call the court and simply ask them how you can verify that the Personal Representative (your brother) is/has paid the tax bill. You can also ask your brother directly for verification. There are other ways. If you really have a concern in this area or possibly other concerns, you can retain a probate attorney who can make sure everything is being taken care of. This attorney would not become an official attorney in the probate case, but could still be of assistance. At some point your brother will need to satisfy the probate court that he paid all debts of the estate. I wish you well.
