Life insurance - daughter from first marriage not named as beneficiary
Question Details:
My mom passed away four months ago. Am I entitled to get a share of her life insurance even though I was not named as one? Only my step-father and my half-brother were named as beneficiaries?
I am not admitted in Hawaii. I am sorry for your loss.
Life insurance policies are said to "pass outside the Will" when a properly executed beneficiary designation is in place. In other words, if everything is proper with the designation then it is not included in the estate, with or without a Will. The payout goes directly to the intended beneficiary.
Unless there are other facts here that give rise to contesting the beneficiary designation it would appear that you are not entitled to the proceeds. Your are, though, entitled to a portion of her estate unless disinherited.
