CT DWI Charge, Miranda rights read but not arrested

Question Details: I was driving and i ran a stop sign and got t-boned and totaled my car, i had been at a party drinking but stopped about and hour before the accident and i don't believe i was over the limit. my car flipped i was bleeding and the officer tried to get me to do a one foot and count test but i was dizzy and needed to sit down and ambulance took me to the hospital, no serious injuries. i received a summons for a misdemeanor DWI and running a stop sign, i have no criminal or misdemeanor record except 1 minor traffic violation. i cant afford an attorney, what should i do?

I am a lawyer in CT and practice in this area of the law.  I suggest that you appear at court and ask to apply for the alcohol education program.  this is a program for first time offenders.  you need to fill out the application and submit it to court. you will then see probation and they will assign you a date for an alcohol evaluation.  this will determine how many classes you have to take.  after you complete all the classes (you have a year to complete them) the case will be dismissed.

As for your Miranda rights, you only need to be read your rights if you have been arrested and are then questioned.  If you were qquestioned but not yet in custody, Miranda does not apply.
