Credit card used without permission

Question Details:

My boyfriend used my card without my permission to a dating on line service. I called to cancel and they said they would refund my money and report to local police. I don't want the police involved.I just wanted my money back. What will happen to my boyfriend? The amount was $70.49

There's a problem here, because you can't have it both ways.  Your boyfriend may be charged with misdemeanor theft; for an amount this small, I think it's unlikely that the prosecutor would try to charge him with any sort of identity theft felony, although it's possible.  If your boyfriend has no prior record, he may be able to get into a diversion program of some sort, which will essentially put him on probation for 18 months or so, and if he finishes that without getting into any more trouble, the charges get dropped so he can have a clean record.

He took your card.  Not only did he take your card, but he used it to get access to other women to date.  You're worried about what will happen to him.  What's wrong with this picture?
