could my neighbor home owner insurance fix my brick wall in my back yard.

Question Details: my neighbor palm tree - trunk grew so big that it broke down part of the brick wall between the property in my back yard. she put in a claim some time last year in may of 2008 and nothing happen,what should I do to get my brick wall replace. I can't sell my property with this type of damage, what could I do to help with out taking my neighbor to court. PS Thank You for your help - damage property.

There's probably nothing you can do, here, without suing.  If the insurance company was going to pay this on the claim your neighbor filed, it would have happened by now, probably long since after more than a year.

The insurance company will defend your neighbor, including hiring and paying for a lawyer to defend your suit.  It shouldn't cost your neighbor anything out of pocket, beyond whatever deductible they have for a loss like this.  Unless you want to pay for the repairs yourself, you don't really have any other choice.
