child support
Question Details: my ex owes $49,000 in back child support. it is going threw the courts. im in NJ and he is in massachusettes, both states have all the info. i have not recieved any money since sept. 2008. nj court just keep saying they sent request and get no reply. is there anything that can be done, to get this moron to pay.
I cannot imagine the frustration you are experiencing in having to chase your ex and at the same time pay for 100% of the child related financial responsibilities because of his defaults.
If your matter is being enforced through the NJ courts, then make certain to first do your research. Sometimes the Probation Department can assist and many other times you need to be resourceful on your own. Since you already know that he is living in Mass, consider finding out:
1) where he works (so you can request a wage garnishment);
2) what his actual work and home address is (so you can request a lien on his property and tax refunds); and
3) when he might be returning to NJ for visitation, family functions, etc (so a bench warrant can be executed for his arrest and incarceration for failure to pay - with his release conditional upon full payment).
NJ and MA are cooperative in working together to respect court Orders entered by the other sate (we call this full faith and credit). You will want to ask your court to have the authorities in both NJ and MA work together to enforce a court Order that you obtain.
Do not give up. Your ex has an obligation to this child. Payment is not an option. It is a mandate. Good luck and please do not hesitate to call if you want to discuss this matter in further detail.
