Question: Divorce, Marriage, Alimony - California

Asked on 10/26/2009

Child support hearing

I obtained a child support order against my son's father. He didn't agree on the amount of the child support granted, so now we are scheduled to be in court in January. What will happen at the hearing? Is it only going to deal with the matter of child support or will the issue of visitation be addressed? That is, will the court give him right to visit my son also? We were never married. Thank you.

If you are scheduled to go to court in January, you have to look at the paperwork that he filed to determine what issues will be relevant for the upcoming hearing.  If you do not have an attorney, I strongly suggest that you hire one.  If you wish to discuss your case further for possible representation, please don't hesitate to contact me.

The court can only change visitation if the paperwork indicates the father's desire to address that issue.  In terms of child support, the court will look at any changes in his income and yours since the last order, as well as any changes of visitation.  You should consider consulting with an attorney to ensure that you get the proper child support, visitation and depending on your income you could get some of your attorney fees paid by the father.
