Question: Divorce, Marriage, Alimony - South Carolina

Asked on 7/15/2009
Child Support
My husband and I divorced in September of 2008, he agreed that he would give me $250.00 a month for child support, he has not given me a dime, I am currently deployed and our son is staying with my ex husband's parents, I think he is giving her $100.00 a month. I was wondering if I am able to take him to court to get more child support from him. The state of SC says I rate $550.00 a month, I agreed to $250.00 because I thought he would live up to the agreement, what can I do to get my son the support he derserves, my ex husband is currently $2500.00 behind in child support.

AttorneyPages has verified that this person is an attorney.

I encourage you to speak to an attorney in South Carolina, however, he is to pay per the court order. You state you have an agreement for child support but you have not stated whether that agreement was made a court order. If it was ordered, then you can file a motion to show cause.
