My car was hit by an unlicensed/uninsured vehicle, how do I go about getting my deductible paid?.

Question Details:

I was stopped at a red light. A vehicle struck the back of my vehicle causing much damage. The driver of the vehicle is unlicensed and has no insurance. Does this fall under Michigan's Tort Law or can I sue for the full amount of my deductible or full amount of damage? My deductible is $1000 and I have 3 estimates ranging from $4000 - $5000 in damage.

I am a lawyer in CT and practice in this area of the law.  You will need to file a claim with your insurance carrier.  You will then likely have to pay the $1000 deductible as this matter is governed under strict contract law.  You should be compensated up to the maximum limit of the policy.  I suggest that you hire a lawyer to represent you in connection with the claim as you may be entitled to pain and suffering damages.  You should go to the hospital to determine whether you have an injury as you will not be able to collect for this injury if you settle without inbjuding any injuries in your claim.
