Car tire came off after recent car service

Question Details:

My car's tire came off while I was driving. Luckily no-one was hurt in the whole incident. The car was damaged as a result. I called my insurance company and they had a tow truck sent; it took me to the nearest shop where I got the vehicle repaired (just good enough to bring it back on road). About 3 weeks back I had the car's shocks changed from a local Auto Shop. As per the guy who towed my vehicle, the auto shop guy should be held responsible for this. But when I contacted the auto shop owner later that day, they said they will at the most pay for the body damage. Please guide.

If the shop had worked on the wheel that came off they are responsible for any damage caused to your car by their negligence. it is just a matter of proof. If you changed the shocks who said they were damaged by the wheel falling off. They should be another auto mechanic and be able to justify why all 4 shocks had to be replaced. Get them to write something up explaining why all four shocks had to be replaced due to the accident and send it to the owner. You could also make a claim through your own insurance under the comprehensive coverage. Again it is all a matter of proof.
