Car Accident Settlement When Car Purchase Included a Rebate

Question Details:

My car was purchased 2 months ago. At that time, the dealer was offering an incentive or rebate, which could be used as a downpayment on the car, or a outright cash/check to the customer. The car was totaled in an accident, and now the insurance company is saying that even though the car was valued at an amount less than was originally paid, they want to offer a check for what the car is valued at, MINUS the rebate. Can they do that? Shouldn't I get the value of the car period?

You are right. A person should be compensated for the value of the car, regardless of how much they paid for it.
