In answering your question you need to answer a couple questions first. Were you or your friend at fault at all. If not then did you have uninsured motorist coverage on your policy or med pay? That coverage must be offered but a lot of times the agents try to talk you out of it to lower your bills. The med pay is there for paying medical bills of the people in your car including yourself regardless of who is at fault. The uninsured motorist coverage is for a situation exactly like this whether the party at fault doesn't have coverage or takes off. In that cause you make a claim against your own insurance for the damages caused by the idiot that hit you and ran off. You must file a demand within 2 years of the collision or you would not be able to collect any benefits.

If you have any of these coverages you should go talk to an attorney experienced in personal injury like ourselves. We offer free consultations to accident injury victims.
