Car Accident, driver got spinal cord injury.
Question Details: My friend who get drunk told me to drove his car which own by his father. I also took some alcohol while driving. Now accident happen that’s I hit a tree. The car was total loss and I became a quadriplegic forever. My friend went to police station and made a false report said that he was the driver and I was a passenger. After that, the car was claimed and the car doesn’t buy passenger insurance. I myself don't buy any personal insurance. Now can I sue him made me injured or anyway I can claim?
I am a Boston attorney. I feel terrible about your situation. However, you say the vehicle does not have passenger insurance. This does not make sense. Every vehicle in Mass. must have insurance and such insurance covers passengers. Unfornuately, the minimum coverage amount is only $20,000 per person with a cap of $40,000 per accident. However, don't assume that the vehcile had the minimum. If you were the passenger, the driver is at fault for the accident and is liable to you. In addition to car insurance available, you want to consider having a claiming against the owner. Also, there could be third-parties liable. Are you and your friend under the legal age to drink. If you were the driver, then you are at fault for the accident. If you are under the legal drinking age, you may have a claim against the person who supplied the alcohol. If you are over the legal drinking age, you are likely out of luck. Regardless, given your injuries, you need to consult with an attorney. Please contatt me if you want to discuss further.

I am a lawyer in CT and practice in this area of the law. This is an unfortunate incident and I feel aweful for you. I think that the there are several problems here with your case from a legal perspective becasue the truth is what matters here. You need to be honest with the police and how the accident happened and who was driving. The true in any event is liely going to come to light during the investigation. Sinc the accident was you fault, you are not going to be compensated under any circumstances that i am aware of. Insurance companies do not pay if the accident was their insured's fault. I do not think that you have a claim against your friend.
