Can I sue for car accident even if my tags were expired?

I had a car accident. A drunk driver ran stop sign and I hit her. I had insurance and my tags were paid but I didn't have new tag yet I needed a smog check before they would give it to me); the old one was expired. My car was totaled and I have injures and personal property that was damaged in this accident. Can I still sue the other driver's insurance with my tag issue?
