cap on pain/suffering in California
Question Details: -In California, is it true that there is no cap on pain/suffering as result of medical fraud? (Repeat: Not negligence but fraud) -Do I have to pay tax on pain/suffering award? If yes, how much? -Do I hv to pay tax on punitive damage award? If yes, how much?

I am a CA lawyer. I have not heard of the term "medical fraud". Either you have a fraud case or a medical malpractice case. The statute defining medical malpractice is very broad. Of course, if the facts fit, it could be elder abuse and the remedies are different. If you have tax questions, I suggest you speak to a tax lawyer or CPA. Check this site for referrals.
