Can't make court date
Question Details:
The court has set a date to discuss visitation between my ex-husband and our children on a date that I am out of the state. thecourt is in NH, we live in VT, and the children and I will be in DC on the court date. What do I do?
Either you or your ex-husband must have filed a motion with the court to "discuss visitation." Although I practice law in Vermont (not NH), I will offer you this suggestion which would apply in Vermont courts. Contact your ex-husband and ask him if he would consent to the postponement of the court date. Send the Court a cover letter and a motion to continue, i.e., postpone, the court date. Explain that you are asking that the court date be postponed because you and the children will be out-of-state. Include that your ex-husband has no objection to the postponement. Send your ex-husband a copy of your letter.
If you and the children have reside in Vermont for more than six months, you could ask the Vermont Family Court to take jurisdiction of your divorce order and all further post-judgment divorce proceedings could be addressed in Vermont.
