Is it legal for an insurance company to threaten to cancel a policy after receiving the down payment based on not having spouse information when the spouse in not listed as driver on the insurance policy?

If they require spousal information, then yes, they may cancel for not having it--you would be breach of the contract.

They should have to return the bulk downpayment, however. Normally, when an insurance policy is canceled for any reason, any part of the payment(s) not applied to provide coverage to date is returned.
