Question: Divorce, Marriage, Alimony - Michigan

Can you threaten a spouse to sign divorce papers or more precise, fraudulent divorce papers?
My wife threatened to have the sheriff serve me at my fathers house if I didn't immediately return a fraudulent divorce petition. She backdated the separation date 12 months instead of the actual 10 days. We had gotten into a argument and I went to stay at my fathers home. 10 days later she had emailed me divorce papers giving her sole custody of our 18 month old son. This can't be legal, can it? Can I get sole custody and support based on these actions?

I am not admitted in Michigan.  Threaten you with what?  Actual proper service of divorce papers?  I wouldn't sign a thing.  It is when they are served that matters here.  

And for the portion regarding your son, if you are contesting it it is doubtful that the court would give her sole custody except in extreme circumstances.  The court uses "the best interests of the child" as criteria for determining custody issues.

Sounds like your wife is just angry.  If you think that she is serious get yourself a lawyer.
