DUI / DWI Law Answers

The short answer is "no", you cannot get a DUI expunged.  However, while permanent, these arrests/convictions are part of your driving record, not your criminal record. While any points will eventually come off (up to three points can be subtracted from your point total each year) the arrests/convictions will remain a part of your permanent driver's record.

Additionally, NJ's as a 10-year "look-back" period.  This means that for penalty purposes, if your second offense is incurred 10 or more years from your first, it will be treated as though it was your first offense.  The court will only "look-back" into your record 10 years.
