Can you fire an employee while they are on light duty?

Question Details:

We have an employee who does not think he has to follow general rules. We have this person in the office on sit down duty only. He uses his cell phone about 10 times a day and will not do what we ask. When we have office discussions he always listens in and puts in his two cents.

Employment and Labor Law Answers

If he doesn't then do the light duty, follow rules or instructions, do his job, etc. Nothing requires you to pay someone to not work; if you have accomodated them with light duty, they still need to do that and follow general rules, such as no excessive phone calls. Just  be sure to document everything well.
