Question Details: I had a critical illness rider on the policy and spouse suffered a qualifying benefit. we were approved and a para med was taken. We applied for the benefits and after a review of medical files they recinded my spouses policy. Can you dispute the recinding of a policy for breach of contract and bad faith prior to the experation date??
Yes you can and you should dispute it. You need to contact an insurance attorney in Delaware who can go over the details with you and find out on what basis they rescinded the policy. You may need to sue them and to file a complaint to your state's health insurance regulatory agency.
