Can we sue for false arrest and excessive force?

Question Details: My wife was handcuff and forced to ride in the back of the patrol car, she had cooperated with the officer during a FST that unfortunately did not pass due to physical abilities. She passed the BAT at the station. She is very traumatized by the ordeal of being handcuffed.

DUI / DWI Law Answers

I am a lawyer in Ct and practice in this area of the law.  The police were doing their job and are required to handcuff people they place in custody.  Plus, the state is immune from liability absent any excessive force used in making the arrest.  I suggest seeing a lawyer to describe the arrest in more detail.  However, it does not seem like the police did anything wrong here.
