Can they file charges and arraignment date at same time?
Question Details: Arrested june 6, was not charged or on doctet on 1st court date givin on ticket. I called July 22 still no charges. Now I recieved a letter saying filing date July 29 and reason initial arraignment schedualed. Next day they mailed me letter saying court date passed and new arraignment for aug. How can they charge me, arraign me and get it reset the same day. Does the prosecutor have to see judge to get it postponed. Should I have been notified?
I am an attorney licensed in MO. Frequently the prosecutor will ask a judge to continue a case if it has been filed too late to notify the defendant. As long as a warrant did not issue, it should not substantially affect your rights. I need more information to fully advise you.
