Question: Wills, Trusts, Probate - Texas

Asked on 11/4/2009
Can the baby mama ask for child support if she was married to someone while she had a baby (that adopted the baby) but got divorced recently?
Well,I got involved with a married(cheating) woman that told me she was getting divorced then, but didn't.When she got pregnant, she told me that she wanted to have a kid because her husband couldn't give her one.So pretty much, she used me.Her husband adopted this kid(his birth certificate he appears as the father)but since I knew it was my kid,I paid child support 4 a year. She later told me that she wanted me to give up father rights & have nothing to do wthe child i did. After cheating once again(w other men),she got recently divorced &wants me to give her money.Does she have any right over me?

I don't think so.  You didn't have to pay her child support for that year, and I hope that doesn't get used against you, if this woman takes you to court.

But I doubt that she will.  If her husband (now ex-husband) signed the birth certificate, and supported the child as his own, and especially if you signed anything giving up your parental rights, she's going absolutely nowhere with this.  I'm guessing she didn't get as much money as she wanted out of the divorce, here.  And I'd also assume that she's getting child support from her ex-husband, until I saw a divorce decree with her name on it that said otherwise.  She can't legally collect from both of you.
