Can someone file arbitration now on a contract that has expired at the end of 2008?
Question Details:
I am a lawyer in CT and practice in this area of the law. If one of the parties is alleging a breach of the contract and there is an arbitration clause, then the party may sue ont he contract and resolve the case in arbitration if the parties are not able to agree. in other words, the right to enforce the contract does not end when the contract ends. If one of the parties breached the contract while it was in existance then the other party is entitled to recourse as long as a claim is filed within 6 years from the date of the alleged breach. i suggest hiring a lawyer to review the contact. most lawyers will meet with you for the first time for free to give you some direction.
