Can my husband's probation period be extended if his fines have not been paid in full?
Question Details:
My husband is about to end a years. probation for a DUI. His probation agent who works an outside contractor now wants him to sign papers to request a 3 month extension because his fine is not paid in full. The court has previously lowered his payments due to his work situation. Can he do anything to fight the extension or is it mandatory?
Technically, while a person is on probation they are to pay all fines and penalties associated with the crime. If they fail to pay the fines in full before the expiration of the probation, they could be held in violation of probation and have to serve the time that is hanging over their head. In this case, the probation agent is actually doing your husband a favor by extending the period so that he can pay the fines off in full and put this entire mess behind him as opposed of making a claim that your husband is in violation of probation for not complying with the terms and condition, which likely required him to pay all the fines within a period of time that has expired. I suggest that your husband pay the fines owed and then be done.
