Can Police hold my vehicle for forfeiture if I haven't been charged yet?
Question Details: I passed an officer speeding and just kept going. I never was signaled to pull over, I just didnt stop. It was obvious I was going to get stopped but the officer was never close to me. I ended up popping my tire and parked my vehicle. I made it home late and after the night went by I reported it stolen the next day. They found it late that day and held on to it because it was suspicious. I admitted to it within the next 2 days and they told me they were taking the car. I went to a hearing and told them that i was talking until my trial. Its been over a month and I have yet to be charged.
Yes. The forfeiture is a totally separate proceeding and you have to challenge the right of the police to seize the vehicle and to forfeit it by separate administrative or judicial action.
