Can my soon to be ex husband stop me from moving from MI to IL with our minor child? The move would be 5.5 hours away.
Question Details: I have filed a motion with the court in MI for change of domicile to IL. The move will be 5.5. hours away. My ex will not agree and is fighting me. I have my brother and his wife in IL. I can make $5-15 more an hour and have full benefits.With my current nursing job I dont have any benefits. With the move i can work daytime hours and be home with my child after school. My ex has our daughter over night sometimes 2, every other week, and continued this thru the summer and does not want a visitation schedule. I have primary physical custody and we have joint legal. can he stop me?
Your ex can fight your move to Ill. However, it appears that you may have a valid reason for the move. It appears that you are trying to better the life of your child. As long as you are not moving to spite your ex and are amenable to continuing to allow him to have a simialr amount of visitaion time, the court may allow your move.
