Question: Divorce, Marriage, Alimony - Pennsylvania

Asked on 7/23/2009
Can my husband make my children and myself return to the state I left? No papers have been filed
I lived in the state of Wyoming and I left my husband and returned to my home state of Pennsylvania where my family is. The relationship became alcohol abusive and I could not stay any longer in the situation. I had left him before and stayed in the state one other time and he broke PFA's and spent time in jail. I have 3 children and I am being told that I can file for nothing (temp custody or divorce papers) until I have been a resident of PA for 6 months. When I can file can he make it that I will have to live in Wyoming cause of the children? I do not want to go back, I am afraid to

I am an attorney in Minnesota and am not certain on PA laws, but there may be a way to have the court exert emergency jurisdiction because of the abuse issue.  A local attorney should be able to assist you.
