Can my aunt get off for drunk driving?

Question Details: My aunt was recently arrested for drunk driving and child endangerment. I believe is a violation of statute 23153 because she crashed the car, hit a tree and a fence, totaled the car, and had her two children, ten and twelve-year olds with her. At her arraignment, the judge told her she would get two years sentence, one if she plead guilty. She plead not guilty. Do you believe she can get off?

Are you asking if she can get off without penalty?  Probably not based on what you said.  If her blood alcohol level was over .08 it is pretty much a done deal.  Does she have priors?  What does she do for a living?  The fact minors were involved ratchets up her chances of being convicted.

Does she have a public defender? If she can afford a private defense attorney, she should try www.attorneypages.com and check his or her disciplinary record at www.calbar.ca.gov under attorney search.
