You can--there's nothing illegal about doing so. If you have an attorney, you should ask their opinion of doing so first; if you don't have an attorney yet, you should get one, since this can affect your legal rights. Be aware that anything you write may be used by plaintiff  against you; e.g. if you take responsibility in letter.
