You can use your spouse's business name and LLC for your business as well, but that would defeat one of the most important purposes of establishing an LLC: asset protection. If you can your wife conduct your respective businesses under the same business name with the same LLC, the assets of each business will be available to satisfy the claims of judgment creditors of the other business. It would be much better to pay the $155.00 to establish a separate LLC for your business. That way if there is a judgment against your business it won't affect your wife's business, and vice versa. It is important to remember to treat each of these LLCs as separate and distinct legal entities to avoid the risk of "piercing the corporate veil," which is what happens when people are sloppy about observing all of the appropriate corporate formalities. If you and your wife don't treat your respective business interests and their LLCs as separate and distinct from you, neither will a court.
