Can I sue the developer over promises during the development of the community to build parks that never materialized?

Were those promises in writing? Did they form part of your consideration to purchase? Is the developer solvent? This is a recurring problem in the current real estate climate - a developer promising amenities that they cannot deliver. You may have recourse against the developer if you answered these questions 'Yes'. Your purchase agreement will control, to a large extent, your recourse. I assume you have a copy. See if this promise is explicitly referred to. Even if it isn't, you may still have recourse if the developer used the promise of parks (say, in promotional materials or commercials) to lure customers.
