Can I sue someone in Nevada if I am being sued for the same reason?

Question Details:

I had rented a house with someone and we got evicted. Both names were on the lease but they can't find her so they are suing me for it. Can I in turn sue her for damages of having to supply all the documents to the courts and missing hours of work to deal with the case against me?

Under the lease you are what is known as "jointly and severally liable".  This means that you can both be sued, or you can be sued individually, as is the case here.  However, you in turn are correct in your assumption that you can sue your ex-roommate for their share of any amount that you are found liable for.  The best venue to pursue your claim in is small claims court (as long as the amount in question is under $5,000; if it is more than that you will probably want to consult with an attorney).

Note:  You need to provide a current address, so do your best to track her down.

Here is a link to a site that will explain further (it references Clark County but the steps are much the same statewide):  http://www.clarkcountycourts.us/lvjc/small-claims.html
