Question: Insurance Law - Illinois

Asked on 11/6/2009
Can I sue my doctor for scheduling procedures at places that don't take my insurance without telling me?
My doctor does procedures out of 2 locations. He chose to schedule me at the place that doesn't take my insurance but didn't tell me. He was the one that performed the procedure and now I have bills that my insurance company tells me I wouldn't have if he scheduled me at the other location which took my insurance.

Your argument sounds reasonable to me, and I think it's worth getting into this with an attorney, if the bills are substantial enough and the doctor won't work something out with you.  This kind of case is usually difficult, but yours has the very helpful fact of the doctor chosing between two locations.  You should, of course, be prepared to have a new doctor take over your care if you do this, since you have no "right" to make him continue to treat you.
