Can I still sue my doctor?
Question Details:
5 years ago I had bunion surgery on my foot twice, within 3 years. The doctor put pins in my foot and I still have bunions and can't move all my toes. but before i could move all my toes and i still have the same problems exxcept before i could move all of my toes; now I'm in more pain than before. Can I sue my doctor for medical malpractice?
It's too late. I'm not an Alabama attorney, but my research suggests that the statute of limitations for personal injury lawsuits in your state is two years; there's a provision for extending that, to a maximum of four years, for medical malpractice that can't be discovered immediately (like something left inside a patient after surgery). But even if you could prove malpractice (which isn't by any means certain), you can't go anywhere with this now.
