Can I sue if the hospital gave someone else's insurance card and mine may have gone to this person?
Question Details: I now know this person's name and his insurance provider and group number. My insurance card included my mother's name my brother's and sister's name our group number my mother's work place address and our insurance provider. Is this a HIPPA violation?
What you have written about is not a HIPPA violation for the sole purpose that confidential medical information about you was not given to a third person not related to your treatment in the medical field. You can sue the hospital for the perceived negilgence in given your insurance card to another person. However, I do not see what your damages would be in terms of dollars and cents from what you have written.
I suggest that you may wish to consult with an attorney that practices in the area of medical law to assist you further.
