Can I sue my landlord for mold in my attic and basement?
Question Details:
I just had my rental house inspected and they found mold in my attic and in my basement. I live in a townhome and there are 4 other buildings with 4 units each; some people in a different unit moved out because of the mold. So can I sue my landlord because he is letting use live in mold?
If the landlord is not making repairs to remove the mold, you could file a lawsuit against the landlord for breach of the implied warranty of habitability. The implied warranty of habitability is in every lease and requires compliance with the local housing code. In your case, the mold is a health hazard and therefore constitutes a breach of the implied warranty of habitability and would render the property in non-compliance with the local housing code.
