Question Details: As I moved to my newly purchased condo, I realize that my neighbor’s parking spot is way too small for a normal size car. It can't park unless doing a some damage to my small car. Can we sue a seller?
I am a lawyer in CT and practice in this area of the law. The problem that you have is that you should of and had the right to an inspection of the property and the parking spot before you purchased the condo. Did you not look at the space? the seller will say that you have the right to inspect the property, which you did, and did not make an issue of this. the fact that you are now bringing it up is most likely untimely. I do not think that you have a good case against the seller. However, you should bring all the documents for the closing to a lawyer to have them reviewed to determine the extent of notice you had that the space was too small.
