Can I still file a civil lawsuit on a debt that is currently being paid on?

Question Details:

I loaned money to a family member just over 3 yrs ago and they are presently making small monthly repayments for these loans. I am trying to increase my monthly payment received. Can I take them to court for the full amount to satisfy the loan?

It depends; is there any document detailing the payment schedule or when the payment is due in full? If so, are they out of compliance with it? If someone has breached or ignored the payment schedule on a debt, they are in breach of the debt instrument and you could sue them.
