Question: Divorce, Marriage, Alimony - Rhode Island

Asked on 11/4/2009

Can I move out-of-state while filing for a divorce?

I need to be closer to work, what will happened if I do move even though the law says I cannot move? It is one state over and only 1 hour away from my ex-husbands home.

If you move, your divorce case will be dismissed once the court finds out about it.  And if you don't tell, and you lie at the final hearing to get the divorce granted, the divorce could be declared void for fraud, later on, and you could be prosecuted for false swearing or perjury.

However, if your husband still lives in the state where your divorce is pending, it might be possible to move without ending the case, but I'd have a lawyer help you with this, if that's the case.
