Question: Business - Texas

Asked on 11/5/2009

Can I include travel expenses if I have to travel out-of-state to sue someone in a small claims court case?

I initiated a purchase online for $500, no longer wanted it, and asked for a refund which the seller is not responding to. I live in TX, he lives in ME, so I will have to travel to his state to sue him in a small claims court. Can I include a round trip plane ticket in my case as reimbursement if I have the receipt? I've already heard you could get reimbursed for court costs.

Why do you want to go to Maine.  One of the advantages to suing in Texas is that the Defendant picks up the travel cost for himself.  Once the defendant put an item into the stream of commerce and intentionally did business in Texas, he exposed himself to Texas Courts.
