Question: Real Estate - North Carolina

Asked on 11/6/2009
Can I get my deposit and past rent back?
I moved into my trailer on august 5, 2009 I paid $505 to move in. There was no heater and he stated he would install it in september well it is now october and I still have no heat, and now the stove is broke. I have never been able to stay there due to no heat and no stove. What can I do? What am I entitled to?

I am a lawyer in CT and practice in this area of the law.  The landlord is required to provide you with access to to a heat source.  if the landlord is not providing the heat access or is suposed to provide you heat and is not, you may leave the property and not have to pay rent.  this is called constructive eviction.  you should not have to pay any rent.  I suggest to see a lawyer to have him write a letter to the landlord explaining the fact that there is no heat and that you will be moving out if the heat is not provided.
