Can I get 50% of my last annual pay for a pension if my position was eliminated?

Question Details: I am out on medical leave. I am going to retire in March of 2010. When I went on medical leave, I was told that there was no guarantee of reinstatement to my position. My position is being eliminated. Am I eligible to receive 50% of my last year's pay as my pension because my position was eliminated? I am a non union city employee. Thank you for your help.

What kind of medical leave did you go out on, and for how long?  If you were out on Family and Medical Leave, you must be reinstated to your position or a like one.  As for your pension, you must read the pension agreement to know that.  If it is too legalistic to read, consult an attorney (it may well be worth it) just to read and advise you on the pension matter.
