Can I be sued if fault has not been identified in a no fault state?

Question Details: I was involved in an accident three years ago. I felt like the other party was at fault and the other party felt like I was at fault. The police on the scence did not write a report until a week or two later however two seperate reports for each party as he originally request that insurance information be exchanged. My insurance paid for my vehicle and now 3 years later I recieve a summons indicating that I am being sued. I live in Florida.

Yes, you can be sued.  However, turn the suit over to your insurance company that had the policy at the time of the accident.
